    Highland Colony Property or Grounds Modification Request

    NOTE REGARDING CHANGES:  

    The purpose of this request form is primarily for the board to be aware of your proposed modification and to ensure the safety of association members and Highland Colony buildings and grounds.  Additionally, an important part of communal living is to  mutually respect the varied aesthetic sensibilities of all members.  In order to protect members and to forestall discord, the board seeks to ensure safety and congeniality among its members.

    While we would generally like to promote your wishes, the New Hampshire Condominium Act places many restrictions on what individual association members and the association itself may do.  Exterior structural changes, for example, are expressly forbidden by New Hampshire's Revised Statutes Annotated Section 356-B:30 356-B:30.

    Most importantly, regardless of the decisions of the board, approval of a request in no way supersedes any legal or zoning limitations that might preclude the possibility of your desired action or in any way limit your own legal jeopardy.  In some cases, a permit from the Town of Holderness may be required before you may legally act on your proposed project.  You would bare the sole responsibility for running afoul of any town ordinance or any damage that results from the improper execution of your project or from any resulting personal harm to yourself or anyone else.  In some cases, in order to protect the community, the board may request proof of your legal permissions before you may proceed. All such considerations are your responsibility.

    In no way should the agreement of the board be interpreted as legal permission to pursue your project.
